Plaintiffs Range Road Music, Inc. ("Range Road"), Jerry Leiber ("Leiber") and Mike Stoller ("Stoller") bring this action against Music Sales Corporation ("MSC") asserting claims for copyright infringement, and against Josephine Van Heusen ("Josephine") and Marshall Gelfand ("Gelfand") for authorization of copyright infringement and for breach of contract. MSC moves for summary judgment solely on the ground that plaintiffs cannot establish ownership of the copyrights at issue. Plaintiffs cross-move for summary judgment based upon the alleged ownership of the copyright extended renewal terms for two songs composed by Josephine Van Heusen's late husband. For the reasons set forth below, MSC's motion for summary judgment is denied and plaintiffs' cross-motion is denied.
